Advertiser Terms
Draft: pending legal review. This is a working draft. It is not legal advice and is not yet in force. Highlighted text in brackets is a placeholder to fill in ([like this]) or an open business decision ([Decision: like this]). Purple "Drafting note" boxes are for reviewers and must be removed before publishing.
These terms apply when you add a brand to Bonus Round, generate creatives, fund an ad account or run campaigns. They add to our Terms of Service. "You" is the advertiser: the brand, or an agency acting for it.
The short version
- Only add a brand you own or are authorised to represent, and only upload material you have the rights to.
- Your creative is generated with AI. Play it and check it before you approve it. Nothing runs until you approve it.
- You prepay. Spend comes out of your balance per viewable impression, engagement or click, and stops at zero. You are never billed beyond your balance.
- Ads are placed by context (brand ↔ game), never by tracking players.
- If an agency places your campaigns through Bonus Round, it earns a disclosed 15% commission out of that spend, shown on your Billing page. You pay the same price either way.
Your brand and your authority
- You may add only a brand that you own, or that you are authorised in writing to advertise for. If you are an agency, you confirm that your client has authorised you, and you are responsible for your client's compliance with these terms. [Decision: Whether to add brand verification, e.g. a domain check, before a brand can fund campaigns; no verification exists today]
- Use your brand's real website. Don't create ads for a brand you don't represent, including as a parody, a test or a pitch, without the brand's permission.
How we learn your brand
- When you add your website, our AI brand agent visits it in an automated browser. It looks at the home page and a few other pages on the same site (such as products, about and mascot pages), takes screenshots, reads text, colours and fonts, and saves your logo and some product or mascot images. It only visits publicly available pages, and if your site blocks automated browsing it does not try to get around the block.
- The agent may also use web search and other public sources, preferring official ones such as your press releases and social profiles. [Decision: Confirm the public sources used in production (e.g. Wikipedia and Wikidata) and list them here]
- Images you upload are treated as the most reliable source and are preferred over anything the agent finds.
- The result is a brand kit: your name, tagline, products, palette, fonts, tone, mascot, and things your ads should avoid. It is generated by AI and may be wrong or incomplete. Please check it.
Brand materials: your promises and our licence
"Brand materials" means your names, trademarks, logos, trade dress, slogans, product names and images, mascots and characters, and any other material you upload, link to, or let our agent collect from your website or public sources about your brand.
You promise that:
- you own the brand materials, or have all the licences and permissions needed for us to use them as these terms allow, including from any photographer, designer, model, musician or other rights-holder;
- the brand materials, your calls to action and your landing pages don't infringe anyone's intellectual property, publicity or privacy rights, and don't include anyone's likeness without their consent;
- any claim in your brand materials or that you approve in a creative (for example about price, health, performance or awards) is truthful, substantiated and lawful in the places your ads may run; and
- you have told us, in your brand kit's "avoid" list or by email, about any restrictions on how your brand may be shown.
You grant us, and the publishers whose games show your ads, a non-exclusive, worldwide, royalty-free licence to use, copy, adapt and transform (for example, into a 3D model, a recoloured arena or a sound effect), display and distribute the brand materials, but only to learn your brand, generate, preview, play-test and serve your creatives, show them to you and your team, and report on them. The licence lasts while you use Bonus Round and for a short period afterwards to wind down campaigns and keep required records.
How creatives are made
For each game you match with, our pipeline generates a playable ad made for that game ("creative"):
- an AI model (Anthropic's Claude) designs a 15-second round from your brand kit and our analysis of the game: the mechanic, scale, arena, hero object, collectibles, copy, audio and an in-world placement;
- an image model (Google Gemini) makes reference art using your brand's own images;
- a 3D model service (Meshy) turns the art into 3D models, which may be rigged and animated;
- an audio service (ElevenLabs) makes a short music bed, sound effects and a synthetic voice-over that reads the round's script; and
- our software assembles the package, then plays it in the game and checks it against a quality checklist.
AI-generated content disclaimer. Creatives are generated automatically and are not reviewed by a person at Bonus Round before you see them. They can contain mistakes: wrong or invented product details, misspelt or distorted logos, inaccurate colours, objects that resemble third-party products, characters or trademarks, music or sounds that resemble existing works, voice-overs that mispronounce names, or text that makes claims you can't support. Automated QA checks gameplay and readability, not legal compliance. [Decision: Whether Bonus Round will add human review for some or all creatives, or for restricted categories]
Review and approval
- Every creative goes to review first. Play it in the game preview before you approve it. Only creatives you have approved can serve, and only in the game they were made for.
- By approving a creative, you confirm that you have reviewed it, that it represents your brand accurately, and that it complies with these terms, the Ad Policy and the law. You are responsible for approved creatives as if you had made them yourself.
- You can reject a creative (and tell us why), and you can pause a campaign at any time.
- Test links. You can create a shareable preview link to a creative. Anyone with the link can play the preview for 30 days, so share it only with people you trust.
- We may reject, pause or remove any creative, campaign or brand that we believe breaks the Ad Policy or the law, or that a publisher reports, even after you approved it. Publishers can also block categories of brands from their games.
Ownership of creatives
[Decision: Ownership model for generated creatives. A proposed default follows; choose between an assignment and a licence of brand-specific outputs]
- Your brand materials stay yours. Nothing in these terms transfers your brand materials to us.
- Brand-specific outputs. To the extent we have rights in them, and once you have paid what you owe us, [Decision: "we assign to you" or "we grant you a perpetual, non-exclusive licence to"] the images, 3D models, textures, audio and copy generated specifically for your brand ("brand outputs"). Some of these may not be protected by copyright, and similar outputs may be generated for others.
- What we keep. We own the Bonus Round platform: the SDK and runtime, round mechanics, templates, procedural fallbacks, arena and leaderboard designs, pipeline, prompts, and the way all of these are combined. The game developer owns its game and the game materials our agent captured (such as its world, characters and art style).
- Using creatives outside Bonus Round. A creative is a playable package built to run inside Bonus Round. You may use screenshots and video captures of your creatives to promote your brand. [Decision: Whether advertisers may export and reuse brand outputs (models, audio, images) outside Bonus Round, and on what terms]
- Our use. We may keep copies of creatives to operate the service, keep records and handle disputes. We will only show your creatives in our marketing, case studies or showcase with your permission. [Decision: Opt-in mechanism for showcase use]
- Third-party terms. Outputs from AI providers are subject to those providers' terms, which may include restrictions on use. [Decision: Confirm that each provider's output terms (Anthropic, Google, Meshy, ElevenLabs) permit commercial advertising use and allow these grants]
Campaigns, bidding and delivery
- Bid strategies. You choose one per campaign:
- vCPM: you pay per 1,000 viewable impressions;
- CPE: you pay per engaged player (a player who entered the round and touched an item, or interacted with the ambient prop); or
- CPC: you pay per click on your call to action.
- Auction. Each ad request runs a second-price auction. Bids are compared on expected value per thousand requests using predicted rates for each game and format, so you usually pay less than your bid, but never less than the publisher's floor or our platform minimum.
- Pacing and caps. We spread your daily budget evenly through the day, stop at your total budget, and apply your frequency cap per anonymous player.
- Targeting is contextual only. You can target game categories and content ratings, and include or exclude specific games. You can't target players by who they are or what they've done.
- Delivery isn't guaranteed. We don't promise any number of impressions, engagements, clicks or results, or that your ads will run in any particular game.
- Bonus Round's own campaigns. Bonus Round advertises itself through an ordinary brand account ("Bonus Round") in the same auction, at the same rules and prices. As a limited launch offer, it may run a campaign targeted at a newly invited developer's game (see the publisher launch offer). [Decision: whether launch-offer campaigns may outbid paying advertisers on that game, or only fill requests no paying campaign wins]
Prepaid balance and billing
- Prepay. Campaigns spend from a prepaid ad balance. You add funds through Stripe Checkout. The minimum top-up is US$50.
- Auto-recharge. You can turn on automatic top-ups when your balance falls below a threshold you choose, or a monthly plan (currently US$250, US$1,000 or US$5,000 a month). By turning these on, you authorise us and Stripe to charge your saved payment method on those terms until you turn them off. You can cancel a monthly plan at any time; it stops at the end of the current period.
- Spend. Each billable event is charged to your balance as it happens, at the auction price. Spend stops at a zero balance: an event is never charged beyond what is left, and your active campaigns pause automatically when the balance runs out. They resume when you top up.
- Test traffic is free. Ads served to games in test mode, and requests marked as tests, are never billed.
- Records. Your balance is the sum of your ledger: deposits, spend, refunds and adjustments. You can see it in the dashboard. Stripe gives you a receipt or invoice for each payment.
- Currency and taxes. Balances and prices are in US dollars. [Decision: Whether top-ups include or add VAT, GST or sales tax, and whether Stripe Tax is used]
- What a balance is. A balance is a prepayment for advertising on Bonus Round. It isn't a bank deposit, doesn't earn interest, and can't be transferred to another account or exchanged for cash except as described under Refunds and adjustments. [Decision: Whether unused balances expire after a period of inactivity, subject to local law]
Agency commission
An advertising agency can run your brand on Bonus Round from its own agency workspace: by creating your brand there, through partner access you give it from your workspace, or by paying for your ad account. We tell you, on your Billing page and on each campaign, when this applies.
- What is agency-placed. A campaign is agency-placed when a member of an agency workspace creates or manages it while acting for that agency (through partner access, or because your brand lives in the agency's workspace), or when your ad account is paid for by an agency workspace. It stays agency-placed only while that agency still has access to your brand or pays for the account. If you end the agency's access, spend from then on is not agency-placed.
- The commission. On agency-placed campaigns the agency earns a commission of 15% of the gross media spend, recorded for each billable event in our ledger. The commission comes out of the media spend, not on top of it: the price you pay per event, your balance and your budgets are the same as for a campaign you run yourself. The game developer's 70% share and our platform fee are calculated on the spend that remains after the commission (see Publisher Terms: net revenue). For example, on US$100 of agency-placed spend the agency earns US$15.00, the developer US$59.50 and Bonus Round US$25.50.
- Disclosure, not rebates. The commission is always shown to you: which campaigns are agency-placed, which agency placed them, the rate and the amount. We don't pay agencies undisclosed rebates, volume bonuses or any other payment based on your spend.
- Your agreement with the agency. Any fees your agency charges you directly, outside Bonus Round, are between you and the agency. [Decision: Whether an advertiser can opt out of agency commission, or ask for it to be passed back to them]
- Eligibility and verification. [Decision: Which agency workspaces are eligible to earn commission, and how agencies are verified before commission is paid (e.g. business verification, proof of client authorisation)]
- Payment timing. Agency commission is paid to the agency on the same schedule as developer earnings (available 30 days after it is earned, minimum US$50, through Stripe Connect). [Decision: Agency commission payment timing, and how commission on refunded, reversed or invalid spend is clawed back]
Agencies should also read the Agency Terms.
Measurement
- Our ad server's counts are the basis for billing. An impression is counted when a sponsored round starts or an ambient prop first appears on screen. A viewable impression is counted under the IAB/MRC Intrinsic In-Game Measurement Guidelines 2.0, as described at /docs/events#viewability: for an ambient prop, at least 50% of its pixels in view, at least 1.5% of the screen and a viewing angle of at most 55°, for one continuous second (two for video or animated surfaces); for a Bonus Round, which fills the screen, two continuous seconds on screen in a visible tab. Engagements and clicks are counted as described above.
- We count at most one event of each type per ad served, and reject event tokens that are expired or tampered with.
- Reports are aggregated per game, day and format. They never include individual player IDs.
Refunds and adjustments
[Decision: Refund and adjustment policy. Open questions for the business and legal review below]
- Invalid traffic. If we find that events you were charged for were invalid (for example, bot traffic or a publisher's self-clicks), we will [Decision: "credit the amount back to your balance automatically" or "credit it on request"] for invalid traffic found within [Decision: Look-back window for IVT credits (e.g. 60 days)]. Credits appear in your ledger as refunds or adjustments.
- Unused balance. [Decision: Whether and how unused prepaid balance can be refunded to the original payment method (e.g. on request, on account closure, minus processing fees)]
- Billing errors. Tell us about a suspected billing error at aidan@dreampark.app within [Decision: Billing-dispute window (e.g. 60 days)] of the charge. If we agree there was an error, we will correct your balance.
- Chargebacks. Please contact us before disputing a payment with your bank. If a payment is charged back, we may pause your campaigns and take the amount back from your balance.
- Nothing in this section limits any refund right you have that cannot be excluded by law.
Your other responsibilities
- Calls to action and landing pages must work, belong to you (or your client), match the brand in the ad, and comply with the Ad Policy. Players may be children, so landing pages linked from games with young audiences must be suitable for them and must not collect personal information from children without verifiable parental consent.
- Advertising law. You are responsible for your ads complying with the advertising, consumer-protection and sector rules that apply to you, such as the US FTC Act and its endorsement and children's advertising guidance, the UK CAP Code, and the EU Unfair Commercial Practices Directive.
- Restricted categories (such as alcohol or gambling) are allowed only as the Ad Policy describes, and you must hold any licences they require.
Term and termination
- You can pause campaigns or stop using Bonus Round at any time.
- We may suspend or end your campaigns or account as described in the Terms of Service.
- Welcome credit. New brand accounts get a one-time promotional credit (currently $20), one per person. It can only be spent on ads, has no cash value, and can't be refunded or transferred. We may withdraw it if it was obtained through duplicate or fake accounts. [Decision: whether the welcome credit expires, and after how long]
- What happens to an unspent balance when an account closes: [Decision: Treatment of unspent balance on closure: refund, credit or forfeit, and whether it differs if we close the account for a breach]
